What Is the ELD Mandate?
The Electronic Logging Device rule (49 CFR §395.8), issued by the Federal Motor Carrier Safety Administration (FMCSA), requires most interstate commercial drivers to use a registered ELD to track hours of service (HOS) automatically. It replaced paper logs and grandfathered AOBRDs, with full enforcement since December 16, 2019.
Who Must Comply
You need an ELD if all of the following apply:
- You drive a commercial motor vehicle (CMV) with GVWR over 10,001 lbs, OR transport placarded hazmat, OR carry 9+ passengers for hire (16+ not-for-hire)
- You operate in interstate commerce (cross state lines, or your cargo does)
- You're required to keep Records of Duty Status (RODS) more than 8 days in any 30-day rolling period
ELD Mandate Exemptions
You do not need an ELD if you fall under one of these:
- Pre-2000 engine: Vehicles with an engine model year before 2000. Note: it's the engine year, not the vehicle year.
- Short-haul (100/150 air-mile): Drivers who stay within 150 air-miles of their reporting location and return each day.
- 8-day rule: Drivers who keep RODS 8 or fewer days in any 30-day period (occasional long-haul).
- Drive-away/tow-away: Operations where the vehicle being driven is the commodity delivered.
A wrong exemption call = out-of-service violation + CSA points + insurance hit. If any doubt, get an ELD. At $15/month, it costs less than one hour of downtime.
